Welcome to byTokn. These Terms of Use govern your access to and use of byTokn’s website, services, and applications (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these terms and all terms incorporated by reference.

Eligibility

You must be at least 18 years old to use our Services. By agreeing to these Terms, you represent and warrant that you are of legal age and that you have the right, authority, and capacity to enter into these Terms.

Prohibited Uses

The services provided by byTokn are intended for lawful uses only. Engaging in any of the following Prohibited Uses is expressly prohibited and may result in the termination of your account and legal action:

• Unlawful Activity: Engaging in activities that violate any law, regulation, or sanctions programs, particularly those administered in the countries where byTokn operates.
• Abusive Activity: Conduct that imposes an unreasonable load on our infrastructure, interferes with our systems, or transmits harmful or disruptive software, such as viruses.
• Fraud: Activities involving fraud, deception, or misleading byTokn or its users.
• Intellectual Property Infringement: Unauthorized use or distribution of copyrighted or trademarked content.
• Gambling and Betting: Participating in gambling or betting activities not compliant with the laws of the jurisdictions involved.
• Regulated Goods: Transactions involving regulated goods such as drugs, alcohol, and tobacco that are not compliant with legal standards.

Terms and Conditions for NFT Purchase

• By proceeding with a transaction, you agree to purchase a newly minted NFT (Digital Asset Representation, “DAR”) Token. This transaction exclusively entails the purchase of the DAR Token; no other product or service is included. Upon completion of this transaction:
  The referral partner will receive the DAR Token, which will be used to fulfill your pending order.
• You will receive a payment receipt confirming your order has been paid, and the referral partner will be immediately informed.

When you use byTokn to purchase an NFT with a credit card, debit card, or any alternative payment method, you acknowledge that:

• You are buying an NFT intended for the redemption of goods and services offered by a specified referral partner.
• Transactions are conducted through byTokn, not directly with the referral partner.
• Certain credit card protections, such as chargebacks or refunds, will not be available for claims related to the referral partner. Any claims or protections will be based solely on the purchase of the NFT within the byTokyn ecosystem.
• By entering your CVV code, you confirm your agreement to these terms.

You understand that byTokn is an NFT minting service provider and does not have any involvement, interest, or responsibility in the products or services offered by the referral partner. Our role is solely to provide an anonymized, secure, reliable, and PCI Level 1 certified payment bridge for purchasing NFTs.

Representations and Warranties

You represent and warrant that:

• All information you provide to byTokn is accurate and truthful.
• You will maintain the accuracy of such information.
• You will keep your sensitive information secure and confidential.

General Provisions

• Changes to Terms: byTokn reserves the right to modify or update these Terms at any time. Changes will be posted on our website and effective immediately. Your continued use of our Services following any such changes constitutes your agreement to those changes.
• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which byTokn is headquartered, without regard to its conflict of law principles.
• Dispute Resolution: Any disputes arising out of these Terms will be resolved through final and binding arbitration, except as noted in these Terms.
